Lindsay Lohan is still on probation from the necklace theft last year – and she could be going back to jail after her arrest earlier this week.

Violating probation can cause a judge to give time behind bars, which is something that would not be new to the 26-year-old Liz & Dick actress.

In fact, last year, Lohan was placed behind bars following a probation violation with 120-day sentence for a couple of driving under the influence charges.  

She was handcuffed and thrown in jail, but was released immediately on bail and served under a house arrest in her home in Venice, Calif. But two other times in 2010, Lohan did spend two weeks in jail.

So will she again play the role of jailbird following her alleged New York City hit-and-run?

It could be a possibility. Lohan’s probation requires the actress to obey the law, or risk returning to be placed behind bars.

After Lohan was arrested for allegedly hitting a pedestrian and fleeing the scene of an accident, results in authorities to consider she must have not abided a law. But Los Angeles prosecutors would need to look into the case for Lohan to be considered going back.

"All that would have to be proved is that there is probable cause to believe she broke a law, and then she would face a probation violation hearing," criminal defense lawyer Troy Slaten tells E! Online (not working on the Lohan case). "At the hearing, the district attorney would have to prove by a preponderance of the evidence—meaning 'more likely than not'—that she broke a law. Then the judge could sentence her up to the max—I believe one year—with credit for time she has already served on that case."

Even though her NYC arrest is on the radar of the Los Angeles City Attorney’s Office, prosecutors haven’t taken any action just yet.

"While this latest arrest in New York may have an impact on [Lohan's] probation," spokesman Frank Mateljan tells the website, "We have not yet received any information from law-enforcement officials here or from NYPD. If or when we do, we will review for any potential action, but nothing has been discussed at this time."
