Britney Spears' bitter ex-manager Sam Lufti has claimed that if she's well enough to judge The X Factor, she's well enough to appear in court.
Lufti filed a huge lawsuit against the star in 2009, suing for defamation and unpaid management fees.
Britney has denied that Lufti was ever her manager, and her conservators argued that she's not mentally competent to testify as a witness.

But, according to TMZ, he has now filed new papers in LA County Superior Court asking the judge to reject the conservators' claims.
The site says Lufti included a DVD of the popstar appearing lucid, articulate and competent on The X Factor USA as the basis of his arguement.
Britney, meanwhile, has been staying occupied with business and announced yesterday that she will appear on the Ellen DeGeneres Show on September 11 to promote the new season of the talent contest.
It returns to screens on September 12 and 13 on Fox.
