Halle Berry is said to be looking to move to France with her daughter Nahla after the actress won primary custody of the child in a bitter legal battle with ex Gabriel Aubry.

The ‘Monster’s Ball’ star has filed papers asking the judge in her custody battle for permission to move with the child and long-time boyfriend Olivier Martinez, sources told TMZ.

This has infuriated Aubry - who is allowed supervised visits with his three-year-old daughter - as he thinks his ex is trying to keep his daughter away from him all together, sources said.

The 45-year-old actress may have a valid argument for the move to Europe on the grounds that it would be safer for Nahla after a man accused breaking into her property was released from jail. Richard Franco, 28, was sentenced to a year in prison and five years probation after being accusing of stalking the Oscar-winning actress.

The news of Berry's bid to move to Europe comes after Aubry, 36, was being investigated for child endangerment and misdemeanor battery which he has denied.

The accusations fuelled the custody dispute in which the Los Angeles County of Department of Children and Family Services recommended the model have monitored visitation.

Social workers have also recommended the pair attend parenting classes together so they can learn to co-parent their daughter better.
