Despite hearing a "strong objection", a judge has dismissed the charges brought against a man that was accused of stalking Selena Gomez.
Thomas Brodnicki, 46, had left the singer-actress in "extreme fear" after she was told of a "serious" death threat that was posed by her alleged stalker.
The 19-year-old gave a statement that she was now terrified while Brodnicki was on the loose. During a preliminary hearing in Los Angeles on Wednesday (November 16), a judge ruled that the prosecution hadn't given enough evidence to show that Brodnicki fully intended to cause Gomez distress or fear, reports The AP.
A temporary restraining order has been kept and now a November 23 hearing has been set where it will be decided if it should be a permanent fixture.
In a statement to E! News, the LA County DA spokesperson said: "After a preliminary hearing, the judge, over our strong objection, ruled that the defendant lacked the intent to cause fear to the victim and dismissed the case. "We are evaluating our next step."
Gomez was not at the hearing in court and has yet to comment.
It's not been a great week for Selena as it's been reported that her boyfriend Justin Bieber's recent baby dramas has put their relationship on the rocks.
