The American Idol judge built a case to try and have her ex barred from selling the tape but last week, a judge in Los Angeles ruled that she had no case and the tape is now for sale.
According to the site, Red Light District, YouPorn.com, and PornHub.com are involved in the bidding war with bids hovering around the $40,000 mark.
It's a low amount as there is allegedly no actual sex in the video, just a bit o' slap 'n' tickle.
