A New York attorney claiming to be the new lawyer for Britney Spears, is preparing to argue the conservatorship of the troubled-singer's estate because it is a serious violation of her civil rights.

Jon Eardley has submitted his legal complaint on behalf of the Gimme More singer in U.S. District Court on Thursday.

“I see the case as a civil rights case,” Eardley told People.com. “These are issues of confinement. Very serious confinement.

"Not allowed to contact her friends. Not allowed to use the phone. Not allowed to come and go as you please. Bodyguards controlling you and so forth."

Spears' father Jamie – who was recently appointed conservator of his daughter's estate – has been given temporary control over the singer's legal and financial affairs until March 10.

On Friday a court spokesperson confirmed the 26-year-old’s case is still being investigated.

"The state and federal issues would have to be litigated among all interested parties involved in Ms. Spears' conservatorship.

"And at this time there is no change to any of her hearing dates on the calendar in state court. It is our view that all current matters remain in full force and effect."
