Richie was arrested and charged after a member of the public saw her driving the wrong way down a highway.
When police arrived at the scene she admitted to smoking pot and taking Vicodin, a popular painkiller.
After being taken down town Richie was released from custody on a 7,700 bail and is currently awaiting the results of a blood test.
Her lawyer Howard Weitzman said of his client: "This is a difficult time for Nicole but she is prepared to accept whatever responsibility is appropriate.
"She intends to continue with her career and will deal with any other issues that need to be addressed".
This is not the first time Richie has had problems with drugs; in 2003 she pleaded guilty to possessing heroin but the charges were dropped after she successfully completed a rehabilitation programme and her probation.
Richie will be back in court on February 7 to face the charges against her.silly little girl.
